Hi, this problem is not new at least for me who discovered eOS since 5.
I hoped this problem gets solved in Odin but did not.
I had this problem in Ubuntu 18 and now as I checked it is solved.
Let me explain the issue, touchpad generally treats a bit weird generally it gets the state of itself from Windows 10, how?
When I disable the touchpad in Windows it is also disabled in eOS and only gets enabled after sleep and when I disable it I won't be able to enable it again with the keyboard button.
Meanwhile, when I enable it in Windows and switch to eOS it is active and cannot be disabled even with the button, I just choose "ignore when mouse is connected" and this option saves me!

This is my touchpad hardware:
